Terms of Use

1. Who may use the Services

You must be at least 18 years old, or the age of majority where you live, to create an account and to accept these Terms. A person under 18 may only use DivineTV through a profile created and supervised by an adult account holder, who is fully responsible for that use (see section 16).

You may not use the Services if you are barred from doing so under the laws of your country, if we have previously suspended or removed your account, or if doing so would violate any law, sanction or regulation.

The Services are operated from Brazil. We make no representation that the content is appropriate or lawful outside Brazil. If you access the Services from elsewhere you do so on your own initiative and are responsible for local compliance.

2. Accounts and profiles

You may sign in with Apple, Google or an email address. You are responsible for everything that happens under your account, for keeping your credentials confidential and for the accuracy of the information you give us. Tell us immediately at yancds@gmail.com if you believe your account was compromised.

An account may hold several viewing profiles (for example, family members or a "Kids" profile). Profiles are not separate accounts: the account holder is responsible for all profiles, their settings and their viewing activity, and all profiles share the account's subscription.

We may refuse, suspend or delete accounts that we reasonably believe were created with false information, in violation of these Terms, in bulk, by automated means or to circumvent a previous suspension.

You can delete your account at any time from Settings. Deletion is permanent. Some records may be kept after deletion where the law requires it or where we need them to resolve disputes or enforce these Terms (see the Privacy Policy).

3. Content on DivineTV and where it comes from

The Services give access to sermons, teachings, Bible stories, films, series, documentaries, radio programmes, short clips, images, text, metadata, translations and other material ("Content"). Content on DivineTV falls into the following categories, and it is important that you understand the difference:

• Third-party video streamed from YouTube. A large part of the catalogue consists of videos published on YouTube by churches, pastors, ministries and Bible-story channels. DivineTV does not host, copy, download, re-encode, store or redistribute these videos. They are displayed inside the Services through the official YouTube embedded player and YouTube API Services, exactly as the rights holders made them publicly available and embeddable on YouTube. The video, its audio, its thumbnail and its title remain the exclusive property of their respective owners, who may change or remove them at any time, which will make them unavailable on DivineTV without notice.
• Content licensed to or produced by DivineTV. Some videos (for example, animated Bible stories and films) are hosted by us on our own content delivery network under licence from their producers or because we produced them. These are offered under the licence in section 9.
• Content generated with the help of artificial intelligence. DivineTV Radio programmes, some titles, descriptions, translations, summaries, classifications and recommendations, and the selection and captioning of short clips, are created, selected or transformed with the help of automated systems and AI models. See section 5.
• Metadata and derived data. Transcripts, captions, timestamps, categories, mood tags, thumbnails at other sizes and similar data are derived automatically from the source material or from publicly available captions and may be inaccurate or incomplete.

Third-party Content does not represent the views of Appsolutely LTDA. Inclusion of a video, pastor, church, channel or ministry on DivineTV is not an endorsement by us, and does not imply any affiliation, sponsorship or partnership between them and us unless we expressly say so. Any trademarks, logos, channel names and images belong to their owners.

We curate what appears on DivineTV and may add, edit, reclassify, hide or remove any Content at any time, for any reason, without notice, including at the request of a rights holder or a person featured in it.

4. Third-party video and the YouTube API Services

DivineTV uses the YouTube API Services and the YouTube embedded player to find, list and play publicly available, embeddable YouTube videos. By using the Services you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms) and acknowledge the Google Privacy Policy (https://policies.google.com/privacy). Playback of YouTube videos is delivered by YouTube and is subject to YouTube's own terms, ads, availability, quality and regional restrictions, none of which we control.

When a YouTube video plays inside DivineTV, your device communicates directly with YouTube/Google, which may set cookies and collect data about you as described in the Google Privacy Policy. We do not receive your Google account information through this process.

We do not sell, rent or claim ownership of any YouTube video. We do not remove, obscure or alter YouTube's branding, watermarks, attributions or player controls beyond what the YouTube API Services allow, and we do not offer downloads of YouTube content. If you are a rights holder and do not want your public YouTube videos to be displayed on DivineTV, contact us (section 10) or restrict embedding on YouTube, and the videos will stop appearing.

Other embedded or linked third-party services (for example app stores, payment providers, social networks, websites of churches or ministries) have their own terms and privacy policies. We are not responsible for them.

5. AI-generated and AI-selected content

You acknowledge and agree that:

• DivineTV Radio programmes (sermons, devotionals, scripture readings, prayers and station announcements) are written by AI language models following editorial rules set by us, checked by automated review systems and read aloud by synthetic, computer-generated voices. The voices are not real people; no programme is a live church service; no human pastor is speaking to you. Bible passages read on the radio are taken from the World English Bible (public domain).
• Short clips in the Shorts feed are excerpts of full videos. The start and end points, the on-screen quote, the categorisation and the ranking are chosen by automated systems and AI classifiers, not by a human editor. A clip may cut a sentence, take a passage out of its context or misrepresent the speaker's complete point. The full video is always one tap away and is the authoritative version.
• Transcripts, captions, translations, summaries, mood and audience classifications (for example 'suitable for kids') and recommendations are produced automatically. They can be wrong. In particular, an automated 'kids' or 'family' classification is not a guarantee that a video is appropriate for your child; parents and guardians must supervise.
• AI outputs may contain errors, hallucinations, doctrinal imprecision or content that some users find inappropriate, despite our safeguards. We do not warrant their accuracy, completeness, theological correctness or fitness for any purpose.
• Portions of Content and of your interactions (for example video titles and descriptions, transcripts, search queries, listener requests to the radio and the reason you give when deleting your account) may be sent to third-party AI providers for processing, as described in the Privacy Policy. We do not send your name, email or payment details to those providers.

Where required by law we label AI-generated content as such. If you believe an AI-generated or AI-selected item is harmful, defamatory, misleading or infringing, report it to yancds@gmail.com and we will review it.

6. DivineTV Radio

DivineTV Radio is an automated, 24/7 audio stream for personal listening. It is provided free of charge and may be interrupted, changed, or discontinued at any time. Listener requests ("play something about…") are matched by automated systems to existing programmes and are not guaranteed to be played, are visible to our staff, and must not contain personal data about other people or unlawful content.

You may not record, redistribute, rebroadcast, play in public venues, embed elsewhere, or use the radio stream for any commercial purpose without our written permission.

7. Shorts

The Shorts feed is personalised. The order in which clips are shown depends on what you and other people watch, skip, like and follow, and on automated classifications of the clips. Personalisation is a core part of this feature and cannot be disabled while using it; you can influence it through your activity and you can delete your viewing history by deleting your profile or account.

Clips from YouTube videos are played through the YouTube embedded player under section 4; clips from content hosted by us are streamed from our servers. Liking a clip, sharing it or opening the full video may be recorded as described in the Privacy Policy.

8. Community, pastors and following

The Community area presents pastors, teachers, ministries and channels whose public content is available on DivineTV, and lets you follow them to receive their new content and notifications. Following is a feature of DivineTV only; it does not create any relationship, subscription, membership or communication channel between you and the pastor, church or channel, and does not notify them.

Profile information about pastors and channels (names, photos, church, city, links, verification badges) is compiled from public sources and from information they provide. A "verified" badge means we have confirmed the identity of the source of the content, not that we endorse the person or their teaching. Report inaccuracies to yancds@gmail.com.

9. Licence to use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the DivineTV apps on devices you own or control and to access and stream Content through the Services, solely for your personal, non-commercial, private viewing and listening.

You may not, and may not allow others to: copy, download (except where we provide an explicit offline download feature for your personal use inside the app), record, capture, screen-record, redistribute, publicly perform, broadcast, sell, rent, lend, sublicense or otherwise exploit any Content; remove or alter any notices, watermarks or attributions; circumvent, disable or interfere with any access control, DRM, token, geographic restriction or security feature; scrape, crawl, mirror or use bots, scripts or automated tools on the Services; reverse-engineer, decompile or attempt to extract source code, models, prompts or data from the Services; use the Services to build a competing product or to train machine-learning models; or access the Services by any means other than the interfaces we provide.

Offline downloads, where offered, are encrypted copies for personal use inside the app only, remain our property, may expire, and are deleted when your subscription ends or your account is deleted.

Apple and Google app store terms. If you obtained the app from the Apple App Store or Google Play, the store's terms also apply, the store is not responsible for the app or its content, and the store is a third-party beneficiary of these Terms with the right to enforce them against you.

10. Intellectual property and takedown requests

The Services, their software, design, databases, brand, logos, radio programmes, original productions and all Content we own or license are protected by copyright, trademark and other laws of Brazil and international treaties. All rights not expressly granted are reserved. "DivineTV" and the DivineTV logo are marks of Appsolutely LTDA.

We respect the rights of creators. We display third-party videos only as their owners made them publicly available and embeddable. If you are a copyright owner, a person featured in a video, or their authorised agent, and you believe that Content on DivineTV infringes your rights, violates your privacy or should not be shown, send a notice to yancds@gmail.com with: (a) identification of the work and of the material you want removed (URL or title in the app); (b) your contact details; (c) a statement that you have a good-faith belief the use is not authorised; (d) a statement, under penalty of perjury where applicable, that the information is accurate and that you are the owner or authorised to act for the owner; and (e) your physical or electronic signature. We will remove or hide the material promptly, and we may terminate the accounts of repeat infringers. For YouTube-hosted videos you may also use YouTube's own copyright tools.

Counter-notices may be sent to the same address. We may forward notices and counter-notices to the other party.

11. Subscriptions, payments and refunds

Parts of the Services require a paid subscription ("Premium"). Prices, billing periods, free trials and features are shown at the point of purchase and may vary by country and platform. Subscriptions are sold and billed by Apple (App Store), Google (Google Play) or Stripe (web checkout), not by us directly. The store or processor's terms, refund rules and consumer protections apply to the transaction; we do not have access to your full payment card details.

Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal through the store where you bought it (Apple ID settings, Google Play subscriptions) or, for web purchases, through the link in your receipt or by contacting us. Deleting the app or your account does NOT cancel a store subscription; you must cancel it with the store.

Free trials convert to a paid subscription automatically unless cancelled before the trial ends. Only one trial per person.

Refunds. Except where the law requires otherwise, payments are non-refundable and there are no refunds or credits for partially used periods, unused Content, or Content that becomes unavailable (including third-party videos removed by their owners). Refund requests for App Store or Google Play purchases must be made to Apple or Google. Consumers in Brazil have the right of withdrawal within 7 days of a purchase made remotely, and consumers in the EU/UK have similar statutory rights; we honour those rights where they apply.

Price changes. We may change prices with notice given through the store or by email at least 30 days before the change takes effect; the new price applies from the next renewal after that period.

Chargebacks and fraud. We may suspend or terminate access if a payment is reversed, disputed or found to be fraudulent.

12. Free tier and fair use

We may offer part of the Services free of charge, for example a limited amount of viewing time per period, DivineTV Radio and Shorts. Free features are provided as a courtesy, may be changed, limited or withdrawn at any time, may include promotional messages or paywalls, and may be subject to fair-use limits (for example per-account viewing caps or device limits). We may throttle, rate-limit or suspend accounts that appear to abuse free features, share accounts, or use automation.

13. Prohibited conduct

In addition to the restrictions in section 9, you agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law, including copyright, privacy, consumer, sanctions and export laws.
• Share your account, sell or transfer it, or create accounts for others without authorisation.
• Upload, submit or transmit anything unlawful, defamatory, harassing, hateful, obscene, violent, infringing, deceptive, or that contains malware.
• Impersonate any person, pastor, church, ministry or DivineTV staff, or misrepresent your affiliation.
• Interfere with, overload, probe, scan or test the vulnerability of the Services, our servers, our content delivery network, our APIs or any third-party service we rely on, or attempt to gain unauthorised access to any of them.
• Circumvent geographic, age, kids-profile, subscription or free-tier restrictions.
• Use the Services to send unsolicited messages, advertising or solicitations, or to collect information about other users.
• Frame, mirror or deep-link to the Services or to Content in a way that presents them as your own.
• Use the Content, transcripts, metadata or radio programmes to train, fine-tune or evaluate artificial-intelligence systems.
• Use the Services to defame, harass or harm any pastor, church, ministry, channel or other person featured in them.

We may investigate violations and cooperate with law enforcement. We may suspend or terminate your access immediately, with or without notice, for any violation.

14. Your submissions and feedback

The Services do not currently allow users to publish videos or public posts. Where you provide us with content or information — for example radio requests, search queries, reasons for deleting your account, support messages, reviews, ideas, suggestions or feedback ("Submissions") — you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to use, store, reproduce, modify, analyse and act on those Submissions for any purpose connected with operating and improving the Services, including training our own ranking and classification rules, without compensation or attribution to you. You represent that you have the rights to make the Submission and that it does not violate the law or the rights of others.

We do not claim ownership of Submissions, and we do not have to use them, keep them confidential (unless they are personal data covered by the Privacy Policy) or pay for them.

15. No professional, pastoral, medical or financial advice

DivineTV provides religious, devotional, educational and entertainment content for general spiritual encouragement. Nothing on the Services — whether produced by a third party, by a pastor, by us or by an AI system — is professional advice of any kind, and nothing creates a pastoral, counselling, therapeutic, medical, legal, financial or fiduciary relationship between you and Appsolutely LTDA, or between you and any person featured in the Content.

Do not rely on the Services to make decisions about your health, mental health, safety, relationships, finances, legal matters or the wellbeing of others. If you are in crisis or thinking about harming yourself or someone else, contact local emergency services immediately (in Brazil: CVV 188 or SAMU 192). Always seek the advice of qualified professionals and of your own church leadership.

Teachings on the Services reflect the views of their speakers or of the AI systems that generated them, may contradict each other, and are not the official doctrine of Appsolutely LTDA.

16. Kids profiles and minors

Kids profiles show only Content that we or our automated systems have flagged as suitable for children. These flags are produced automatically and may be wrong; some third-party videos are also outside our control. Kids profiles are a convenience for parents and guardians, not a certified child-safety product, and do not replace adult supervision.

The account holder is responsible for creating Kids profiles, for choosing what a child may watch, for supervising the child's use of the device and for any purchases made from the account. We do not knowingly collect personal data from children under 13 (or 16 where a higher age applies) other than the viewing activity of a Kids profile, which is stored under the adult account holder's account (see the Privacy Policy). If you believe a child has provided us personal data directly, contact yancds@gmail.com and we will delete it.

17. Availability, changes and termination

We may modify, suspend or discontinue all or part of the Services, any feature, any Content and any price at any time without liability to you. Content — and especially third-party video — may become unavailable when its owner removes it, restricts embedding, changes region availability or when a third-party service changes its rules. We do not promise that any particular video, pastor, channel, programme or feature will remain available.

You may stop using the Services and delete your account at any time. We may terminate or suspend your account and access, with or without notice, if you violate these Terms, if required by law, if we discontinue the Services, or if we reasonably believe it is necessary to protect the Services, other users or third parties. On termination your licence ends, offline downloads are removed and you must stop using the Services. Sections that by their nature should survive (including 9, 10, 14, 18, 19, 20, 21 and 23) survive termination. Termination does not entitle you to any refund except where the law requires it.

18. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, TO THE FULLEST EXTENT PERMITTED BY LAW. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT: THE SERVICES WILL BE UNINTERRUPTED, SECURE, TIMELY OR ERROR-FREE; ANY CONTENT (INCLUDING THIRD-PARTY VIDEO, AI-GENERATED PROGRAMMES, TRANSCRIPTS, CLASSIFICATIONS, TRANSLATIONS, RECOMMENDATIONS OR "KIDS" FLAGS) IS ACCURATE, COMPLETE, RELIABLE, LAWFUL, APPROPRIATE OR THEOLOGICALLY SOUND; THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; ANY CONTENT WILL REMAIN AVAILABLE; OR THAT ERRORS WILL BE CORRECTED. WE ARE NOT RESPONSIBLE FOR THE CONDUCT, STATEMENTS, TEACHINGS OR CONTENT OF ANY THIRD PARTY, PASTOR, CHURCH, MINISTRY, CHANNEL OR OTHER USER, WHETHER ONLINE OR OFFLINE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

19. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL APPSOLUTELY LTDA, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, CONTENT PROVIDERS OR SUPPLIERS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY OR USE, OR FOR ANY EMOTIONAL, SPIRITUAL OR REPUTATIONAL HARM, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE ABOVE, WE ARE NOT LIABLE FOR: (A) ANY CONTENT, INCLUDING ITS ACCURACY, LEGALITY, AVAILABILITY OR THE ACTS OR OMISSIONS OF ITS OWNERS; (B) ANY AI-GENERATED OR AI-SELECTED MATERIAL OR ANY DECISION YOU MAKE IN RELIANCE ON IT; (C) ANY THIRD-PARTY SERVICE, INCLUDING YOUTUBE, GOOGLE, APPLE, STRIPE, CONTENT DELIVERY NETWORKS, AI PROVIDERS, EMAIL PROVIDERS AND ANALYTICS PROVIDERS; (D) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS; (E) LOSS OF OFFLINE DOWNLOADS, VIEWING HISTORY, PROFILES OR PREFERENCES; OR (F) ANY DAMAGE TO YOUR DEVICE OR DATA COST INCURRED BY STREAMING.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US (NOT TO THIRD-PARTY STORES) FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (II) BRL 100 (ONE HUNDRED BRAZILIAN REAIS).

THESE LIMITATIONS ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

20. Indemnification

You agree to defend, indemnify and hold harmless Appsolutely LTDA and its owners, directors, employees, contractors, agents, licensors and suppliers from and against any claims, liabilities, damages, losses, fines, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Services or Content; (b) your Submissions; (c) your breach of these Terms or of any law; (d) your violation of the rights of any third party, including intellectual property and privacy rights; (e) any use of the Services by a child or other person through your account or profiles; or (f) any chargeback or payment dispute you initiate in bad faith. We may assume the exclusive defence of any matter subject to indemnification, and you agree to cooperate.

21. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before starting any formal proceeding, you agree to contact us at yancds@gmail.com describing the dispute and to negotiate in good faith for at least 30 days. Most issues can be resolved this way.

Jurisdiction. Subject to the mandatory rights of consumers (who may bring claims in the courts of their own domicile under the Brazilian Consumer Defence Code or equivalent local consumer law), the courts of the City of Curitiba, State of Paraná, Brazil, have exclusive jurisdiction over any dispute, and you waive any other venue.

Class-action waiver. To the fullest extent permitted by applicable law, you and we agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective or representative action. If this waiver is found unenforceable for a particular claim, that claim proceeds in court, not as a class action.

Time limit. To the fullest extent permitted by law, any claim arising out of the Services or these Terms must be filed within one (1) year after it arose; otherwise it is permanently barred.

22. Consumer rights that cannot be waived

Nothing in these Terms excludes or limits any right or remedy that you have under mandatory law where you live (for example the Brazilian Consumer Defence Code, the Brazilian Civil Rights Framework for the Internet, the EU Consumer Rights Directive, the UK Consumer Rights Act or the laws of a US state) and that cannot lawfully be excluded, limited or waived. Where these Terms conflict with such a right, the right prevails to the extent of the conflict, and the rest of these Terms remain in force.

23. General provisions

Entire agreement. These Terms, the Privacy Policy and any additional terms we publish for specific features are the entire agreement between you and us regarding the Services and replace all prior agreements.

Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full force.

No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms. We may assign them, in whole or part, to an affiliate or to a successor in connection with a merger, acquisition, reorganisation or sale of assets, without notice.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of third-party platforms, content providers, hosting, CDN, AI or payment providers, internet failures, strikes, government action, pandemics or natural disasters.

Electronic communications. You consent to receive communications from us electronically (in-app, push notifications where you allow them, email) and agree that such communications satisfy any legal requirement that they be in writing. You can disable marketing emails and push notifications at any time; transactional and legal notices may still be sent.

Language. These Terms are written in English. Translations are provided for convenience; the English version prevails, except where local law requires otherwise.

Export and sanctions. You may not use the Services if you are located in a country subject to a comprehensive embargo or are on a sanctions list applicable to us.

Relationship. Nothing in these Terms creates any partnership, joint venture, employment, franchise or agency relationship between you and us or between us and any pastor, church, ministry or channel featured on DivineTV.
